I don’t have a will prepared and want to make one. Can I make it myself?
Yes, you can but sometimes it is worth having a lawyer or notary public help you organize and prepare the document, even if it’s just a simple will.
It might not be as expensive as you think to hire a professional. You should be able to get some free quotes, so ask around. Sometimes there may be will clinics offered in the community.
Did you know that in BC, a handwritten will is acceptable and legal if it meets certain requirements:
- Must be in writing either typed or handwritten
- Must have a date on it
- Must be signed by the will maker and two witnesses who must be present and sign the will in front of you
A will-maker must be over 16, mentally capable to make a will, and freely agree to what the will says, ie if proven in court that someone pressured the will-maker to sign a will, the will won’t be valid.
The witnesses must be over 19 years old and not be spouses who are executors or beneficiaries under the will.
